Dispute Resolution & Litigation

Corporate, trust and commercial litigation

Innova Law has expertise in all aspects of international and domestic commercial litigation, including:-

  • asset and debt recovery proceedings
  • misrepresentation, breach of fiduciary duty and fraud
  • receiverships, company liquidations and personal insolvency
  • pre-action disclosure and other interlocutory remedies such as freezing orders.

We can also help trustees, beneficiaries, and trust protectors in Court litigation.

Example cases:

  • Joint Liquidators of former TCSP: various instructions relating to complex winding-up, including in relation to underlying trusts and companies.
  • Excalibur Almaz and others v Horie: instruction from Defendant to act as trial advocate in early 2025 for a case listed for a 13 day hearing in late April and May 2025. Claimant’s claim to enforce a settlement agreement, including indemnity for costs in proceedings in Texas. Claimant argued that an earlier settlement agreement precluded the Defendant’s claim of alleged fraudulent misrepresentation relating to his US$49m investment into a space tourism venture.
  • Funds A and B: acting for the local directors of two regulated funds which were seeking the appointment of Receivers as a means to free up assets and bank accounts of the funds frozen on account of certain non-voting shareholders being subject to sanctions.
  • Property Freezing Order: acting for a number of different and unrelated parties whose assets were frozen using civil powers under the Proceeds of Crime Act 2008, securing the release of funds and/or negotiating a settlement by consent.

Public and administrative law

We can act in any Court or Tribunal proceedings involving a statutory right of appeal or a doleance (judicial review) claim. We have lots of experience before most of the Island’s statutory Tribunals, having led on numerous cases representing the Government. Our inside expertise will help secure best outcomes in cases involving

  • public and administrative law
  • human rights and equalities claims

Example cases:

  • Representing Manx Care in doleance proceedings relating to admission of market entrant to the Isle of Man NHS Pharmaceutical List.
  • Representing Douglas City Council in proceedings relating to the lawfulness of a prior informal agreement relied upon by Treasury as a basis to discount and/or zero rate properties

Planning and environmental law

Innova Law can offer unrivalled on-Island experience in dealing with planning and environmental matters, having appeared at numerous public inquiries for contentious or large-scale planning applications, planning appeals, and area plans and development orders.

Example case

  • First ever on-island advocate to be appointed by Cabinet Office to lead presentation of evidence in statutory public inquiry into an Area Plan under the Town and Country Planning Act 1999.

Employment

Innova Law can assist with the representation of employers and employees, including all manner of contentious employment-related matters. Keiron Murray has appeared in and led numerous high-profile employment Tribunal cases brought against Government, bringing a forensic eye to the detail of cases but never losing sight of the bigger human narrative.

Damages litigation

Regulatory action

We offer an experienced team able to respond quickly and effectively when advice is required on regulatory or compliance matters or representation is required in any hearing or other proceedings e.g. professional bodies, GSC, FSA etc.

We have recent and relevant experience in acting for and against Government regulators, something that allows us to ensure that our clients get the best possible outcomes should any enforcement action be undertaken against them or their business.

Legal risk and governance; in-house support

We have long-standing expertise in assessing and mitigating legal risks for regulated businesses and professionals. We will help with any queries relating to corporate and governance matters.
